Compensation win for parents of a child who was stillborn

  • September 23, 2014
  • When Sarah experienced pain three days before her due date, she went into hospital. The situation quickly escalated into an emergency. A registrar managed to deliver the baby up to the shoulders but it took more than fifty more minutes for the baby’s head to be delivered. The delay between the baby’s torso and head delivery meant that a fatally low level of oxygen was allowed to the baby’s brain, and it could not survive.

Sarah approached our birth injury claims specialists for help with securing damages for suffering and loss, as a result of the negligent care they received.

    Understanding Sarah’s Claim

When Sarah went into hospital she was examined, to try to discover whether the position of the baby was contributing to the pain. Only on the third attempt, with a different nurse, was the baby’s position discovered to be breach. In attempting to ascertain the baby’s position, the midwife deliberately broke Sarah’s waters, without informing her of the risks of doing so.

The situation quickly escalated into an emergency. A registrar managed to deliver the baby, over the next half an hour, up to the shoulders. It was only at this point that the delivery team called for a consultant.

Finally, the baby’s head was delivered, more than fifty minutes later. There were no signs of life so the birthing team attempted resuscitation for eighteen minutes. They were not successful.

The delay between the baby’s torso delivery and the head being delivered meant that the baby’s brain received a fatally low level of oxygen. It could not survive.
The hospital investigation found that strict procedures should have been followed, once the team recognised that it was not going to be an ordinary birth. Had this been the case, they stated, Sarah’s baby would have survived.

Medical Accident Group secured damages for the parents for suffering and loss as a result of the negligent care they received.
