Inadequate monitoring lead to brain damage and cerebral palsy
Edwin was born with a number of serious problems and required cardiac surgery at the age of 2. There was inadequate monitoring of his temperature post-operatively, leading to brain damage and cerebral palsy. Despite a potential number of competing causes, the case was pursued and liability admitted.
Medical Accident Group’s Ally Taft is continuing to investigate the case. There are complex issues on the form of the award (periodical payment versus lump sum) due to the client now living in Ireland, which is likely to set a precedent for other Irish and European cases. A change in the Irish taxation law is awaited before final settlement and advice has been provided from key financial experts instructed by Ally both in the UK and in Ireland.
