Master R suffered a devastating brain injury during his birth after clinicians failed to perform an emergency caesarean section in time. Despite clear signs that labour was not progressing, delivery was delayed for many hours, causing him to suffer a serious brain injury as a result of a lack of oxygen.
Life-long support
His family came to Ally Taft at Medical Accident Group to find answers and to seek help. As a result of the delay in delivery, Master R was diagnosed with four-limb cerebral palsy, epilepsy, and visual impairment. He is unable to walk independently and requires full-time care, along with regular physiotherapy, occupational therapy, and speech and language therapy.
The case was complex, spanning several years, and requiring evidence from multiple medical specialities. Master R has now started secondary school and is progressing well with significant support already in place following interim payments of damages to assist and improve his quality of life.
The hospital trust denied liability, but an agreement was eventually reached which resulted in a settlement of a £3.1 million lump sum and annual payments for care for life, ensuring our client receives the support and resources he will require for the rest of his life.
Looking ahead
Ally Taft said “The family fought hard alongside us over many years to secure the best possible outcome for Master R and I was so pleased we were able to achieve this settlement for him. The money will ensure he is looked after for as long as he lives, even when his parents are no longer able to provide care for him. He can now access fully adapted accommodation, equipment and therapies to ensure his quality of life can be maximised.”
