Making a Claim

Five steps to making a claim

Making a claim might seem alarming, but it all starts with the first simple steps.

  1. Call us now on 0800 050 1668 or email us at [email protected] or fill in the form below.
  2. Tell our team where and how the accident or the problem with your healthcare happened.
  3. We will start to look at your claim, and review any medical records, to understand whether you have grounds for compensation.
  4. We’ll advise you on the best course of action.
  5. In the majority of cases we’ll operate on a no-win-no-fee basis, so you don’t need to be put off bringing a claim by the cost. This means that if you do not win your case, you will not be expected to pay any fees or charges.

Call us now on 0800 050 1668 or email us at [email protected] – take that first step towards your future.

What we do

No Win, No Fee Solicitors

We operate on a no win, no fee basis. We don’t want you to be put off making a claim because you’re worried about the cost of seeking legal advice. We believe justice should be available to everyone.

What does no win, no fee mean?

This means that, if you do not win your case, you will not be expected to pay any fees or charges. Unlike some other firms, with Medical Accident Group, you won’t even have to pay things like experts’ fees as you go along – these are the expenses that we will pay out to others to support your claim.

How does no win, no fee work?

  1. We start with a no obligation consultation with one of our expert team. We’ll discuss your experience and determine whether or not you are eligible to make a claim.
  2. We will then explore funding options with you. In the majority of cases we handle claims on a no win, no fee basis.
  3. If this is the case we’ll offer you what is called a Conditional Fee Agreement (CFA). This is a simple method of covering the legal costs involved where the Medical Accident Group agrees to take no payment until the end of the case. In the event of a win, our costs will be covered by the opposition and we will charge you a success fee for the risks that we are taking up to a limit of 25% of your award for general damages for pain and suffering, and loss of amenity, and damages for pecuniary loss, other than future pecuniary loss; if the case is lost, we take no fee, and there is no cost to you.

What happens if I lose my case?

As part of your no-win-no-fee agreement, we’ll take out an ‘after the event’ (ATE) insurance policy on your behalf. An ATE is only taken out once the legal case has begun, and is specifically designed to protect clients whose claims are unsuccessful. The policy will cover costs outside of our control, such as expert fees, court fees and any opponent’s costs.

The cost of the ATE insurance policy is deferred until the end of the case, and would be deducted from damages. If the case is unsuccessful, no payment is required, as the premium is self-insuring.
