Surgery error leaves patient in long term pain

    Understanding Larry’s Orthopaedic Negligence Claim

    Larry had worked as a roofer for most of his life. He lived a relatively healthy lifestyle and even played football, occasionally.

    One day, however, he suffered an accident at work and fell off a two-storey roof. He damaged his hip badly and was rushed to hospital. The doctor’s assessing him decided he needed urgent surgery, to correct what could turn into long-term damage.

    The next day Larry was told the surgery was not risky and that it was “fairly routine” for that surgeon. They explained that it involved putting pins into the hip to secure the joints from moving or shattering again.

    Although he was in a lot of pain Larry was happy when he was told the use of his hip would go back to 95% of what it had been previously.

    After a long surgery, the surgeon came to see Larry, to go through the x-rays of the procedure, post operation. While looking at them, however, the surgeon noticed something, looked confused and left the room. A short while later, a nurse arrived and explained the things Larry needed to do to help the hip heal. They explained that it might not be fully functioning for another six months.

    Even once six months had passed, however, Larry still felt a lot of pain coupled with severely reduced movement in his hip.

    When he visited another specialist he was told that the pins had been inserted incorrectly and that they should have shown up on the x-ray post operation. He needed a further two operations to correctly insert the pins.

    This orthopaedic error meant that several months had passed, during which Larry’s problems had been made worse. As a result he is now unable to regain half of the movement he should have in his hip.
